Regulators
The rules are being written
In January 2026 the staff of three SEC divisions stated that the format in which a security is issued, or the way holders are recorded, does not change how the federal securities laws apply, and distinguished tokenization by the issuer from tokenization by third parties. A staff statement is a view, not a Commission rule.
